A new study by the University of California, Berkeley, Wildlife Conservation Society, and others uses a new scientific methodology for establishing marine protected areas in Madagascar that offers a "diversified portfolio" of management options ? from strict no-take zones to areas that would allow fishing.

The methodology looks at existing information on the country's climate, along with dependence on fisheries and marine resources, and applies three different planning approaches to establish priorities for management along the entirety of Madagascar's west coast.

The diversified portfolio approach to marine conservation greatly increases the likelihood of finding and implementing successful management that fits a country's needs while simplifying the process of picking locations and the most appropriate forms of marine management, the authors say.

Considering the need to develop a management regime for the reefs and mangroves of Madagascar that factors in the impacts of climate change, the methodology recommends a range of conservation areas with strict no-take protection as only one type of management recommendation.

The paper appears in the February 16th issue of the open access journal PLoS One. Authors include: Thomas Allnut, Merrill Baker, and Claire Kremen of the University of California, Berkeley; Tim McClanahan, Caleb McClennen, Andry Rakotomanjaka, and Tantely Tianarisoa of the Wildlife Conservation Society; Erwann Lagabrielle and Serge Andrefouet of the Institut de Recherche pour le D?veloppement; and Reg Watson of the University of British Columbia.

The authors say the process provides a more efficient and comprehensive way to plan on a large scale and found that several marine areas in Madagascar come out as conservation priorities across all methodologies. Specifically, these included reefs in the vicinity of the Barren Islands, the large shallow banks to the northwest and southwest, and the reefs of Juan de Nova.

The study highlights the differences in the country's regional patterns. These include heavy human pressure in the south and areas of high climate variability intermixed with lower vulnerability but high biodiversity in the northwest. Areas of particularly high biodiversity value include the islands, reefs, and bays of the northwest; the fringing reefs of the southwest; and the barrier reefs and islands of the central west coast.

Madagascar is one of the poorest countries on Earth yet has proposed to create over 1 million hectares (3,861 square miles) of protected areas to provide for the long-term conservation of its marine resources.

"It behooves countries, in the face of impending fisheries and climate crises, to plan and implement intelligent management that will increase the resilience of their natural marine resources," said co-author Tim McClanahan of the Wildlife Conservation Society, "This paper will provide a roadmap for Madagascar to plan and manage these resources and the methods should prove affordable and useful for the poorest countries where adaptation to climate change will make marine spatial planning a critical part of a successful response."

Co-author Caleb McClennen, WCS Director for Marine Programs, said: "Creation of protected areas is a key conservation strategy to safeguarding marine resources, but one size doesn't fit all. This study demonstrates the need for a comprehensive portfolio of management solutions from community based coastal fisheries to fully protected marine parks."

You've heard of singin' in the rain (and have likely seen the movie). You may have even attempted it once or twice, but tableting in the midst of a downpour? That doesn't exactly conjure the same whimsy and spontaneous dance numbers. Yet, Pantech's making such joyous, on-the-go content consumption possible with the aptly named Element. It's yet another addition to the growing stable of LTE devices propping up AT&T's newly expanded 4G fort. Rather than run the risk of this being seen as another garden-variety Honeycomb tablet, though, Pantech's imbued this guy with waterproofing.

Of course, that's not all this skinned Android slate's bringing to the party. With a dual-core 1.5GHz Qualcomm Snapdragon APQ8060 CPU complemented by 1GB RAM, a 1024 x 768 TFT XGA display and a healthy 6,400mAh battery, this impermeable tab stands on equal spec footing with its post-PC peers. At $299 on two-year contract, it's certainly priced to sell, but should you dish out the dollars for a middle-ground tablet from the likes of a lesser-known manufacturer? Does a limited and possibly frivolous imperviousness to water warrant your attention? Should you stash that plastic until Pantech confirms an ETA for that Ice Cream Sandwich upgrade? Find all this out and more after the break, as we force this 8-incher to brave the elements.


Hardware

Pantech previously tested the waters of unconventional design when it launched the low-end, oddly shaped Pocket late last year. Though that flair for non-conformity isn't really on display here with the Element, there's still a certain je ne sais quoi about its build. Lift it out the box and you'll immediately be struck by how elegant this middle-of-the-road tablet appears. True, the company opted for lightweight plastic throughout, eschewing the heavier (albeit premium) materials weighing down HTC's Jetstream. But it hardly matters: this slate simply feels great in hand. It's not an altogether perfect fit, ergonomically speaking -- the plastic bordering the perimeter sticks out ever-so slightly to interrupt the smoothly curved edges. It's a minor imperfection that would be really irritating were it not for this guy's 16.6-ounce weight, which makes it neither too heavy to hold for long periods of time, nor so light that it feels flimsy.

Whereas the Xyboard 8.2 is tall, thin and trim, the Element is possessed of a huskier build; it's short, squat and rife with asymmetry. At 8.36 x 6.12 x 0.42 inches (212.34 x 155 x 10.67mm), this is clearly an acquired taste compared to more refined offerings. Still, that idiosyncratic design comes with benefits. Like that microSD card slot tucked away at the base, giving users the option to expand the slate's 16GB of internal storage with a 32GB card. That slot, along with HDMI-out, micro-USB and an easily accessible SIM, are hidden under grooved plastic flaps designed to keep water at bay for up to 30 minutes at a depth of one foot. That same motif comes into play again where other hardware keys are concerned, although the structural implementation is drastically different, with a mostly smooth cover shielding the headphone jack on the left and a rectangular rubber cushion surrounding and rising above the power button up top. The volume rocker is the only external detail to not benefit from any of this waterproofing.


Changing things up a bit is the placement of the Element's speaker and 2-megapixel front-facing camera, both of which reside on the tablet's left bezel, when held in landscape. Normally relegated to the upper most corner of a tablet, this new location communicates a subtle message: that the device should be held in portrait. Indeed, that orientation is the most comfortable option for handling the device. Check out the other side, and you won't be greeted with much aside from that glossy, subtly patterned plastic back, a prominent 4G LTE logo and the 5-megapixel camera located in the upper right. Beneath the non-removable casing are the aforementioned Qualcomm APQ8060 chip (the same as in the LG Nitro HD and HTC Vivid) and that 6,400mAh battery.
Display and sound

While it pales in comparison to sharper 1280 x 800 panels used on other 7- and 8-inch tablets, the Element's TFT XGA screen offers up a reasonably sharp image given its 1024 x 768 resolution. Truly, this device appears suited for heavy media consumption, as we noticed little loss in visibility and contrast when handling the tablet from a variety of positions. Take it outside, however, and you'll be hard-pressed to discern anything on screen, even with the brightness bumped up to the maximum. It's a minor ding that hampers the Element's overall ruggedness, so if you plan to call this tab your own, make sure to head for the shade.


Unlike the powerful, dual-speaker setup found on the HTC Jetstream, the sole, front-mounted one used on the Element is serviceable at best, though thankfully the audio doesn't suffer from tinniness. That said, it's easy for the sounds to be overpowered by environmental noise and, we can say that with confidence after having repeatedly cranked the volume to its highest setting. Suffice to say, we recommend keeping a pair of headphones close by.
Cameras

When we first took the Element's 5-megapixel camera out for a spin, we suspected something might be amiss, that the module itself was busted or that, despite its sealed enclosure, water had seeped into its interior during a twenty-minute walk in the rain. Our fears arose from our initial crop of photos, taken just before a light dusting of snow fell, leaving us with a handful of blurry, washed-out stills that seemed to mock our attempts to manually tap-to-focus. And forget about using the zoom function; we had zero luck attaining a clear, usable image.

Surprisingly, shots taken in macro fared much better, but, again, performance was largely hit-or-miss. Later on in the day, after the temperature had risen slightly, we found our growing catalog of pictures taking on a much more distinct (albeit muted) quality. Weather conditions aside, this rear shooter delivered consistent results when shots were framed within a shallow depth of field. Move outside of that narrow range and expect the level of detail to drop drastically.


Amateur photogs looking to mess about with a host of scene modes and exposure settings won't be disappointed by the array available in the Element's camera app. You'll find the usual selection (Portrait, Landscape, Indoor, etc.) but on the whole, the menu is structured so haphazardly that finding your desired filter will entail a few missteps.
When it comes to 720p video, the Element once again under delivers. With little to no movement of the device itself, the scene captured will evince only a slight reduction in frame rate and clarity. Move gently from side to side, though, and that's when you notice how severe of an effect this dearth of image stabilization has on the product, proving this HD capture feature is most ideal for capturing fleeting, YouTube-able clips. Audio playback was slightly muffled, but that was partly due to the high winds whipping at the time, given we were still able to hear traces of the surrounding intersection.
Network speeds

There are two immediate truths about AT&T's LTE network in New York City: when it's available, it's mind-bogglingly fast, maxing out at 60Mbps down. And when it's MIA, you won't really notice. Why? Well, with HSPA+ as a default network option, you'll still be treated to fairly high speeds that hover in the mid-teens. Indeed, this type of downlink performance is a clear demotion from the typical 30Mbps and up we achieved in real-world LTE testing, but unless you're monitoring a speedtesting app, you probably won't notice. Those fallback 4G frequencies are strong enough to shoulder the demands of streaming music and video, texts and emails, all while delivering various email and other push notifications. Understandably, if you're paying for use of that 700MHz spectrum, you should want abundant, unfettered access to it. Unfortunately, the operator's still in the baby steps build-out phase, so coverage around New York City, at least, is spotty, with our connection frequently dropping down to HSPA only to latch onto LTE a block later. Overall, those high-end 4G speeds stayed within the 30Mbps to 50Mbps range for downlink and 9Mbps to 11Mbps up.
Performance and battery life

Bolstered by that dual-core 1.5GHz Qualcomm APQ8060 CPU and 1GB of RAM, the Element zips along without nary a hiccup. Tellingly, in all of our time testing the tablet, we didn't once encounter the lag and hesitant transitions so often associated with skinned Android devices. The touchscreen is responsive, shifting between the five preset home screens with ease, and that same fluidity is on display when you tap the app drawer and loading applications. Browsing on the tablet is much of the same, with quick page renders when connected to LTE, and without any of that tiling that besots other Honeycomb slates.

As far as benchmarks go, Pantech's tab consistently outclassed the lower-clocked Xyboard 8.2 and T-Mobile Springboard in our usual suite of testing, save for SunSpider and NenaMark 1, respectively. Those particular losses were marginal at best and don't speak to the remarkable daily performance.

So is there a big, fat battery to keep this tab humming along and indulge its LTE capability? Why, yes, there is and a tremendous 6,400mAh at that. The Element is, without doubt, going to get you through a long flight or Netflix marathon with enough juice left over to surf the web and shoot off some Twitter updates. With light usage, we found the Element lasted the span of a couple of days, and that's with LTE enabled -- all told, in line with the company's claims. Factor in the demands of a power user and, according to Pantech's PR, this slate should survive up to 12 hours on a charge -- and it does exactly that, if you happen to be in an HSPA+ only area of coverage. Put through the paces of our formal battery rundown while connected to LTE, however, and that half-day stamina shrinks to a workable nine hours.

We know most of you are hankering for a cold taste of Ice Cream Sandwich -- that's if you haven't already bought into Google's most recent Nexus flagship -- but you won't find your appetite for Mountain View's latest sated here. All we know is, it's coming at some unspecified point this year. For now, you've got Android 3.2 Honeycomb and a skinned version, at that, with the typical assortment of home screen shortcuts and widgets at your disposal. Don't fret, as the customizations are seriously minor and won't impede your ability to navigate the OS. What might give you pause is the collection of 20-plus apps that come pre-installed. It's not that we don't expect to see crapware like Enzo's Pinball, Bug Village and AT&T's bevy of apps (Code Scanner, Navigator, etc.) shoveled onto Android devices at this stage in the game, but we'd like to see the practice executed with a measure of restraint. Most frustrating of all, you can't uninstall any of that bloat from the settings menu and return your tab to the virgin state you'd expect to find it in.
Pricing and data plans

Pantech, as a brand, doesn't have the cachet of other, more boutique device manufacturers, so it can't rely on name recognition alone to sell its LTE duo: the Element and Burst. Which is why a limited time bundle offered by AT&T makes sense for subs looking to take the plunge (almost quite literally) with this tab and its accompanying smartphone sibling. Both devices are currently available for $250 on a two-year contract, along with the requisite minimum service plans: $35/mo for the Element, in addition to $40/mo for voice and $20/mo of data for the Burst.

If you choose to go solo with your tablet purchase, but still want to take part in that subsidized pricing, you'll be able to snag the Element for $300 on contract with one of two set options: 3GB/mo plus access to AT&T's WIFi hotspots for $35 or a $50 option that nets you 5GB of data. Unlike T-Mobile and Verizon, however, you will have to pay $10 for every 1GB of data over your allotted monthly limit.

Those looking to steer clear of carrier chains can fork up $450 to buy this tablet outright -- pricing that puts it on par with T-Mobile's Springboard and undercuts the $600 Xyboard 8.2 -- to take advantage of a tad more plan flexibility. If you only intend to make extremely light use of your tablet, there is a $15/mo choice that gets you 250MB and the same access to the operator's hotspots. Be mindful, though, that every 250MB over your allotment will result in an additional $15 fee.

Wrap-up

Admit it: an 8-inch waterproof, LTE-enabled tablet makes for a pretty compelling purchase on paper. Couple those sweet-spot features with solid, everyday performance, a smooth Honeycomb-based user experience and a 6,400mAh charge that'll last through nearly half a day of heavy use and you've got yourself several strong reasons to think long and hard about this guy. But when you factor in the sad state of the Element's dual camera setup and its poor outdoor visibility, you might start to feel precognitive pangs of buyer's remorse kicking in.

So, what's the verdict? Should you clasp this slate to your breast and dance about in a torrential downpour, belting out showtunes and banging out tweets in full gale force, or do we order Pantech's tab to walk the plank, and sink below its one-foot threshold? Well, we'll let price be the deciding factor here and at $300 on two-year contract, it's perfectly positioned to lure consumers away from Motorola's comparatively overpriced ($430 on contract) and underperforming Xyboard 8.2 -- all you're missing out on is that familiar Droid branding. Take AT&T up on its tempting limited time bundle that pairs this unit up with Pantech's other LTE spawn the Burst and you'll really be stretching the limits of your purchasing power. As a standalone product, however, and without the backing of a major marketing push, the Element's likely to disappear, undeservedly, into the unending stream of me-too Android tablets; a middle-ground oddity coming out of nowhere and attracting little-to-no attention.

Now that it's finished, and now that I know how EASY it was, I should have done this improvement the week that I moved to this apartment.

You see, I had a shower head that barely put out any water. ?It kinda just dripped on me. Often it was difficult to get all of the shampoo/conditioner out of my hair and during the winter months, it was downright COLD to stand in a shower that dripped!

I knew it didn't need to be this way. ?When I ran water via the tub faucet, it came out at full blast. ?This wasn't a water pressure issue, but what was causing the problem? ?One thing I noticed was that water wasn't coming out of every single hole in the shower head. ?I wondered if perhaps lime, calcium, rust and whatever else had built up in the head, limiting my water supply. ?However, I was terrified of removing the head. ?I mean, what if I messed it up and then went DAYS without a shower while I waited for a repair man?

Well, yesterday I googled "install shower head" or something to that effect and came up with this little youtube gem. ?If you watch it, you will see that it is SUPER EASY to remove and re-install your shower head. ?What a doofus I was for waiting so long!


You just put a little cloth over the shower head (to protect the metal) and then turn a wrench. ?For those of you who, like me, always get confused as to which way you should turn/screw items, the general rule of thumb is, "Lefty, loosey. ?Righty, tighty." ?I'm not sure where I learned that, but it's super valuable information, especially if you're left-handed and nothing in this world feels intuitive because everything is set-up backwards. ?I've always wanted to learn Arabic because that language is written down correctly!

Upon removing the shower head I found THIS item in the neck!

My finger is placed next to the disk to give you an idea of the TINY-TINY hole through which all my water had to flow to get through to my shower head. ?This has got to be the WORST water saver disk that I have ever seen! ?I figured that the removal of this puppy would likely relieve most of my problems, but since I'd already disconnected the head, I went ahead and gave it a good cleaning to remove any deposits.

I filled a mop bucket with heated vinegar, submerged the shower head, and let it sit overnight. ?The next day I blew through the neck end, and yes, turns out there was some rust in there. ?Not only that, but my shower head looks super clean and all brand new-like now. ?Whoo-hoo!


With a little bit of this magic tapey stuff, I put the head back on and gave it a go. I actually had the tape laying around the house because I'd bought it when I installed the bathroom sink faucet as a 'just in case.' ?You can get it for a dollar at Lowe's or Home Depot.
After a trial run of checking the holes in the head, I took to the stubborn ones with a safety pin to clear out any excess gunk keeping them clogged. ?There were about four holes that needed this, substantially less than when I started this venture. And who knew that the center piece was supposed to rotate?!?!? (Wish I'd taken a before picture of this.) The end result?
It's amazing, people. ?Just amazing. ?Tons of water and at a decent pressure. ?I'm not sure I'll ever leave this apartment. ?If you've got a similar problem with your shower (which occurs fairly often in older homes), do this. ?Do this now. ?You will be so happy, and trust me, you can do it. ?It's easy.

High court dilemma: Can lie about medal be crime?

(AP) ? Xavier Alvarez was in good company when he stood up at a public meeting and called himself a wounded war veteran who had received the top military award, the Medal of Honor.

Alvarez was lying about his medal, his wounds and his military service, but he wasn't the first man to invent war exploits.

He was, however, one of the first people prosecuted under a 2006 federal law aimed at curbing false claims of military valor.

Concerns that the law improperly limits speech and turns people into criminals for things they say, rather than do, are at the heart of the Supreme Court's review of his case and the Stolen Valor Act.

Veterans groups have come to the aid of the Obama administration, which calls the law a narrowly crafted effort to protect the system of military awards that was established during the Revolutionary war by Gen. George Washington. The high court will hear the case Wednesday, which is Washington's 280th birthday.

"They're committing fraud. They're impersonating somebody else. They take on attributes of somebody else, attributes of a hero who served honorably," said Pam Sterner, whose college term paper calling for the law wound up in the hands of members of Congress. "When you do that, impersonating someone else, that's fraud, not freedom of speech."

Civil liberties groups, writers, publishers and news media outlets, including The Associated Press, have told the justices they worry the law, and especially the administration's defense of it, could lead to more attempts by government to regulate speech.

When he established military decorations in 1782, seven years before he was elected as the nation's first president, Washington himself also prescribed severe military punishment for soldiers who purported to be medal winners but weren't. Since then, many men have embellished their war records, and some have won special recognition.

It long has been a federal crime to wear unearned medals, but mere claims of being decorated were beyond the reach of law enforcement.

The House of Representatives has more than once voted to name a post office after men who claimed awards they never received. The Air Force named an award after a man who falsely claimed to have survived the Bataan Death March and been awarded the Silver Star in World War II. The Boxing Writers of America named its perseverance award after the late Pat Putnam of Sports Illustrated because of his made-up tale of surviving a Chinese prisoner of war camp in the Korean War and receiving a Navy Cross.

The Stolen Valor Act aimed to solve that problem, and garnered significant support in Congress during a time of war.

"The admiration and respect for the military increased dramatically after 9/11 and the false claims, as well," said Thomas A. Cottone Jr., a retired FBI agent who investigated phony award cases.

Alvarez made his claims by way of introducing himself as an elected member of the Three Valleys Municipal Water District in Pomona, Calif. There is nothing to suggest that he received anything in exchange or that listeners especially believed him.

Even Alvarez' lawyers acknowledged their client sometimes has trouble telling the truth. "Xavier Alvarez lied," they declare in the first sentence of their Supreme Court brief and go on to recount six separate lies in the next few lines.

He lied when he claimed he played hockey for the Detroit Red Wings, married a Mexican starlet who made paparazzi swoon, was an engineer, rescued the American ambassador during the Iranian hostage crisis and was shot when he went back for the U.S. flag. Alvarez also lied, they said, when he talked about his military service.

But the lies Alvarez told harmed no one, they said, so what he did couldn't be considered fraud.

A three-judge panel of the 9th U.S. Circuit Court of Appeals in San Francisco struck down the law as an unconstitutional restraint on free speech and said the government might instead invest in an awards database that would make it harder for people to lay claim to medals they never won. Last month, the 10th U.S. Circuit Court of Appeals in Denver upheld the law in a separate case, saying the First Amendment does not always protect false statements.

The issue might never have reached this stage if not for the efforts of Sterner, and her husband, Doug.

He is a decorated Vietnam veteran who has made it his work in recent years to ensure that service members get the recognition they deserve and expose those who falsely claim acts of heroism under fire. Rather than wait for the government to act, Doug Sterner has entered nearly 100,000 award citations since Civil War in his online database, including all 3,475 Medal of Honor winners in U.S. history. His archive is used by the Military Times newspapers, published by Gannett Co.

Pam Sterner went back to school in her early 40s at Colorado State University in Pueblo, Colo. In a political science course, she wrote a paper that grew out of her husband's frustrations over phony award claimants whose worst punishment was public embarrassment. That paper eventually led to the Stolen Valor Act.

Doug Sterner's database did not save Rep. Jason Chaffetz, R-Utah, from some embarrassment when he invited cameras and reporters to watch him pin medals on an elderly Korean War veteran in June.

The veteran, Myron Brown of Utah, said his Distinguished Service Cross and Silver Star were awarded belatedly, and he asked Chaffetz to present them to him publicly.

After the ceremony took place, Sterner and others raised questions about the medals and the Pentagon confirmed to Chaffetz in December that they were not authentic.

"Others have been burned by this. I have too, but I want to solve the problem," Chaffetz told the Salt Lake Tribune. He is planning a hearing of the House Oversight and Government Reform subcommittee he leads to explore creating a government-run awards database.

MINEOLA, N.Y. (CBSNewYork) ? Seven former and current students of a prestigious Long Island high school were arrested Tuesday in an alleged SAT cheating ring.

Nassau County District Attorney Kathleen Rice announced that six Great Neck North High School students had paid 19-year-old Samuel Eshaghoff thousands of dollars to take the SAT for them.

Eshaghoff, who graduated from the high school in 2010 and is currently enrolled at Emory University in Atlanta, was paid between ,500 and ,500 per student. He has been arrested and charged with scheme to defraud, falsifying business records and criminal impersonation.

Eshaghoff faces up to four years in prison if convicted, but his attorney said there?s no way this alleged scam should end up in a court room. Bail was set at ,000 for Eshaghoff.

?Even if something happened it happened within school grounds, under age, should be handled administratively within school. Across the U.S. no one has ever had a case go to criminal court due to cheating or alleged cheating in an exam,? Matin Emouna told CBS 2?s Jennifer McLogan.

Rice said the students got caught because their SAT scores were so much higher than their school grades, some with as high as 2200 out of a perfect 2400, reports CBS 2?s McLogan. Rice is recommending that all schools who know a student who has cheated on the SAT notify the college the student has applied to.

?The goal here is not only to hold those accountable for their wrongdoing, but to level the playing field for all of the students who play by the rules,? Rice said.

Eshaghoff apparently also took the test at no charge for a female student.

An investigation is currently underway into whether similar scams occurred in at least two other Nassau County high schools, as well as allegations that Eshaghoff took the SAT exam for students of other high schools. Rice would not name those schools.

The Great Neck School District released a statement saying it ?does not tolerate cheating? and remains ?committed to cooperating with law enforcement in the matter.?

Great Neck educator Barbara Rothman tried to explain how this could have happened.

?There is a tremendous amount of pressure on these students in a town like Great Neck,? Rothman told McLogan.

Many students were defensive.

?I don?t think they should be arrested. I think the school should be taking care of it, not the court,? Nicole Nicholis said.

Rice demanded Education Testing Service, the non-profit that administers the test, make other immediate security changes like matching photos and handwriting. Late Tuesday night the ETS said it will comply immediately.

FARMINGDALE, N.Y. ? A security firm run by the former director of the FBI has been retained to review security ? and will recommend changes ? on standardized testing procedures following an SAT cheating scandal on New York?s Long Island, officials with the nonprofit organizations behind the tests said Tuesday.

The officials from The College Board and Educational Testing Service made the announcement at a hearing of the New York state Senate?s subcommittee on higher education. The ETS administers the SAT on behalf of the Princeton, N.J.-based College Board.

Sen. Kenneth LaValle, the subcommittee chairman, convened the hearing after seven current or former students at Great Neck North High School were arrested last month. Authorities said six of the students had an older college student who had attended the high school take their exams in their place in a quest for better scores.

The scandal surfaced when teachers at the school heard rumors of the scheme earlier this year and found that some of the student scores were far better than their high school grades had been previously.

LaValle and others have questioned test security procedures in the wake of the scandal, particularly focusing on the allegation that the accused impersonator, 19-year-old Samuel Eshaghoff, allegedly posed as a female during one of the tests. Eshaghoff also is accused of accepting payments of up to ,500 for taking the tests. He and the other six, who are accused of misdemeanors, have all pleaded not guilty.

LaValle noted in remarks at the start of the hearing that there is increasing pressure on students to perform well on the tests, which are used by many universities as criteria for admission.

"Education is critically important," LaValle said. "It gives one a ticket to their success. This committee and our legislature and our society cannot tolerate where one group of students play by different rules that give them an advantage over other students. Sadly, the losers in this are the honest, hard-working students who play by the rules."

He said he will introduce legislation early next year to change existing laws that sometimes prevent the College Board or ETS from notifying schools when allegations of cheating have been confirmed.

Nassau County District Attorney Kathleen Rice, who filed criminal charges in the Great Neck case, said her investigation has widened to other high schools ? both public and private schools ? and more arrests are expected. She was initially expected to testify at the hearing, but withdrew because of potential conflicts with the ongoing investigation.

Former West Virginia Gov. Gaston Caperton, who is now the president of The College Board, said the cheating scandal has prompted an international review of security testing procedures. He said Freeh Group International Solutions, LLC, which was founded by former FBI director Louis J. Freeh, has been retained to assist with security concerns.

Caperton insisted that impostors taking SATs for another student is a rarity. He said security changes being considered include a review of what would be acceptable ID information and possibly using digital photography at testing sites. He did not provide a timetable for when Freeh?s company would make recommendations, but appeared willing to accede to whatever changes are suggested.

LaValle sought assurances that the cost of any security upgrades not be passed along to students taking the test. Caperton?s spokesman, Peter Kauffmann, said it is too early to know whether additional costs would be incurred.

The College Board, which charges for the test, has faced criticism from some educators over fees. This year it says it granted fee waivers to 350,000 students ? an increase of 77 percent in the last four years ? because of the weak economy.

Bernard Kaplan, the principal at Great Neck North, criticized the lack of security procedures employed by the College Board and ETS. But he said he could not answer questions, citing the ongoing prosecution case involving his school. He noted that Eshaghoff did not allegedly take the tests at Great Neck North, but went elsewhere so he wouldn?t be recognized. Some senators have questioned the effectiveness of allowing students to take the exam at locations other than at their own high schools; something that is currently permitted.

"Many, many educators have come to believe that the SATs are over used, over emphasized, and generally given much more credibility than they warrant," Kaplan said. "In fact, what SATs measure best is how well you will do on your next SATs."

Kaplan added: "Very simply, ETS has made it very easy to cheat, very difficult to get caught, and has failed to include schools in the process."

Another critic of standardized testing contended that more can be done to improve test security.

Bob Schaeffer of FairTest, said photos of all students should be taken when they arrive at a school to take the SAT, something that Caperton said is now being considered.

"As the Great Neck scandal demonstrates, the current level of security is inadequate," he said. "Savvy students can circumvent these minimal protections with relative ease, particularly by using modern technologies to forge identity cards, covertly copy exam materials, or secretly transmit correct answers."
